TERMS AND CONDITIONS

Epta Car Rental & Tours Sdn. Bhd.
(“the Company”)


1. General Terms

1.1 These Terms and Conditions (“Agreement”) govern all vehicle rentals provided by Epta Car Rental & Tours Sdn. Bhd. (“the Company”).
1.2 By confirming a booking, the renter (“Renter”) acknowledges that he or she has read, understood, and agreed to be bound by the terms herein and all applicable laws and regulations of Malaysia.
1.3 The Company reserves the right to vary, amend, or update these Terms and Conditions at any time without prior notice. Any such amendments shall take effect immediately upon posting on the Company’s website or as otherwise communicated.


2. Driver Requirements

2.1 The minimum age for self-drive rentals is twenty-one (21) years, and the driver must hold a valid driving licence for at least one (1) year.
2.2 Both Malaysian and International Driving Licences are accepted, provided they are valid under Malaysian law.
2.3 Additional drivers must be registered and approved by the Company prior to the commencement of the rental period.


3. Rental Period and Extension

3.1 Rental rates are calculated on a twenty-four (24) hour basis. All rates are quoted in Ringgit Malaysia (RM) and are subject to change without prior notice.
3.2 Any extension of rental must be paid in full at the time of the request and shall form part of this Agreement.
3.3 The Company reserves the right to repossess the vehicle without notice if payment is overdue or if the vehicle is used in breach of this Agreement. All costs incurred in repossession or recovery shall be borne by the Renter.
3.4 Late returns exceeding one (1) hour from the agreed return time may incur additional charges or one (1) extra day’s rental fee.


4. Payment and Security Deposit

4.1 Full payment of the rental fee must be made before vehicle collection.
4.2 A refundable security deposit is required and shall vary according to the vehicle category.
4.3 The deposit will be refunded within seven (7) working days after vehicle return, subject to final inspection and deductions (if any) for:

  • Damage, loss, or missing accessories;
  • Fuel shortage;
  • Traffic summonses, parking fines, or other penalties;
  • Cross-district/outbound fee;
  • Cleaning or restoration fees;
  • Etc.

 
5. Insurance and Excess

5.1 All vehicles are insured under a standard comprehensive motor insurance policy. However, the Renter is responsible for the insurance excess, as follows:

5.2 Excess Protection does not cover loss or damage arising from negligence, illegal use, off-road driving, or improper handling. It also excludes:

  • Tyre punctures or blowouts;
  • Battery drain due to negligence;
  • Fuel contamination;
  • Loss or damage to accessories or keys.

5.3 Insurance coverage is valid only for collisions between two (2) moving vehicles. Stationary damage, undercarriage, windscreen, and overhead damage are at the Renter’s sole risk.
5.4 In the event of an accident involving a third party, the Renter must collect and provide the third party’s name, IC/passport number, driving licence, and vehicle registration number. Failure to do so may result in full liability for damages.
5.5 The Renter must immediately notify the Company of any accident, theft, or loss. A police report must be made within twenty-four (24) hours after the accident or upon discovering the theft or loss.


6. Vehicle Usage and Condition

6.1 Vehicles are to be used within Malaysia only, unless written permission is granted.
6.2 For rentals originating in island territories (e.g., Langkawi, Labuan), the vehicle must not be transported to the mainland.
6.3 The vehicle shall not be used for:

  • Any illegal activity or purpose;
  • Racing, speed testing, or off-road driving;
  • Towing or carrying hazardous goods;
  • Driving under the influence of alcohol, drugs, or illegal substances.

6.4 Smoking, carrying pets, or transporting durians, salted fish, strong perfumes, or similar odorous materials are strictly prohibited. A minimum cleaning fee of RM300 will be imposed for any violation.
6.5 The Renter must return the vehicle in clean and good condition. Failure to do so may result in additional cleaning or restoration fees.

7. Child Seat Add-On
7.1 Child seat is available upon request at RM20 per day.
7.2 Subject to availability and must be booked in advance.

7.3 Any damage, loss, or heavy dirtiness will incur a replacement or cleaning fee, deductible from the security deposit.


8. Renter’s Responsibilities

8.1 The Renter shall: 

  • Keep the vehicle locked and secured when not in use;
  • Be responsible for lost keys;
  • Not perform or authorise repairs without the Company’s written consent;
  • Report defects or damage immediately;
  • Cease driving and inform the Company if the vehicle overheats.

8.2 The Renter must not sell, lease, or otherwise part with possession or control of the vehicle or any of its parts. 

9. Owner’s Obligations

9.1 The Company shall supply the vehicle in a safe and roadworthy condition.
9.2 The Company shall bear all ordinary maintenance and repair costs, except fuel and those arising from the Renter’s negligence or misuse.


10. Personal Belongings

The Company is not responsible for any loss of the Renter’s personal items left in the vehicle upon return.


11. Out-of-Hour Pickup and Drop-Off Charges

11.1 Out-of-Hour Pickup refers to any vehicle collection made outside the Company’s standard operating hours (7:00 a.m. to 8:00 p.m., Malaysia Time) or as displayed at the rental station. A service charge between RM50 and RM300 may apply, depending on the time and location.
11.2 Out-of-Hour Drop-Off refers to any vehicle return made outside standard operating hours. Where the Company has agreed to such arrangement, the Renter remains fully responsible for the vehicle until it is physically inspected by the Company’s authorised representative during the next working period.
11.3 Any damage, theft, parking offence, or loss discovered before the next working day shall be deemed to have occurred during the Renter’s possession.
11.4 The Company reserves the right to decline out-of-hour pickup or drop-off requests based on operational limitations or safety considerations.


12. Cross-District / Outbound Fee

12.1 For rentals in Sabah or Sarawak, a Crossing District Fee/Outbound Fee applies when the vehicle travels beyond a 70km radius from the pickup location.
12.2 The Renter must inform the Company in advance. Failure to do so may result in penalties or termination of the rental agreement.


13. Fuel Policy

13.1 Vehicles must be returned with the same fuel level as when collected. A refuelling charge applies for shortages.
13.2 Only the correct fuel type must be used.


14. Traffic Offences

14.1 The Renter is solely responsible for all traffic and parking offences incurred during the rental period.
14.2 The Company reserves the right to deduct related amounts from the security deposit.


15. Cancellation and Refund Policy
  • More than 5 days before pickup: Full refund, less 20% administrative fee.
  • 3–5 days before pickup: 50% refund.
  • Less than 48 hours or No-show: No refund.
  • Refunds (if applicable) will be processed within seven (7) working days.

 
16. Vehicle Breakdown or Replacement

15.1 In the event of a mechanical breakdown, the Company will provide roadside assistance or a replacement vehicle (subject to availability).
15.2 No refund or replacement will be provided for accidents caused by Renter negligence or misuse.


17. Service Tax

17.1 All rental charges, optional services, and related fees are subject to Service Tax (SST) at the prevailing rate as prescribed under the Service Tax Act 2018 and the Service Tax (Rate of Tax) Order 2022, or any subsequent amendments thereto.
17.2 The Service Tax shall be borne by the Renter and will be added to the total amount payable.
17.3 The Company reserves the right to adjust its rates and charges to reflect any changes in tax laws, rates, or government regulations affecting the rental industry.


18. Termination of Agreement

18.1 This Agreement shall be terminated immediately if:

  • The Renter fails to make any payment due;
  • The Renter breaches any term of this Agreement;
  • The Renter becomes bankrupt, insolvent, or under receivership.

18.2 Upon termination, the Company may repossess the vehicle immediately without prior notice.

19. Governing Law

19.1 This Agreement shall be governed by and construed in accordance with the laws of Malaysia, and any disputes shall be subject to the exclusive jurisdiction of the Malaysian courts.
19.2 If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
